Qualified no. You can file any time but you cannot get certain remedies if you sue for infringement unless you have filed before (or very shortly after) said infringement.

Which uh, I imagine a bunch of folks are real fuckin pissed about in light of the Anthropic suit. Is it worth them reminding the publisher of their duty per the contract so it can be filed now?
