Even if what he was saying was correct and non-citizens don’t have a right to due process, the state would have to SHOW that the detainee was a non-citizen which would require…wait for it…DUE PROCESS!!

My point is that without due process for all, the government can disappear anyone they want at any time (which apparently the GOP is cool with) simply by claiming anyone they disappear isn’t a member of the protected class and they have to prove that because…no due process. It’s a catch 22.

So even if the constitution didn’t specify, it would still be necessary to grant it to all accused persons in order to protect the protected class.
