Every Supreme Court ruling changes how the Constitution is applied. The site keeps track of that and lower court rulings as necessary. No one is rewriting the Constitution without a ratified amendment.

Sherry @sherry2.bsky.social

Yes, it changes how it is applied - without changing the document - so why were select segments of the document suddenly omitted from the document? It should remain untouched unless it is amended through proper procedures.

It looks like they still use XML so when the went to update the annotations they screwed up the tags and the CSS made it display improperly. Could it have been intentional? Sure, but this one feels more like a genuine mistake than the other things we've seen during the Trump administration.

Kai Blaschke @kblaschke.kb-dev.net

If they would do that, they'd have staging tests before pushing content or code changes to production, and at least have some manual QA in that process as well. Not all edits may be that obvious, so catching them before going live would be key. Can't imagine such a big bug went through that net.

aug 7, 2025, 8:20 am • 2 0 • view
avatar
Kai Blaschke @kblaschke.kb-dev.net

The only explanations are that they either have no QA process at all, which would be quite bad, or the change was made on purpose and didn't "slip through". As said in the prev post, I can't imagine they don't have any checks in place, so I tend to the latter option.

aug 7, 2025, 8:22 am • 2 0 • view
avatar
Mike Lissner @michaeljaylissner.com

A few missing pieces could be easy to miss in a QA process that assumes XML crashes when it’s malformed. If their plan was to change the constitution on purpose, why would they revert almost instantly? Obviously, people are going to notice.

So two sections go missing and a 3rd section is cut in half for a few weeks. Why would you be changing the codes on those static pages? Broken links are possible, but the editing of the text in section 8 would be a different type of error.

This is an annotated version of the constitution, which they update regularly with new links to court cases and resources.

That still doesn't explain why the actual text changed. Such an issue would in general only affect the annotations or break the whole document, and not make just those very specific passages of the original document disappear. It's not how such code behaves.

Plus, for such an important site, you'd have development and staging tests before sending a code change to production. I'm quite sure this website is following this pattern and doesn't depend on live edits of the production website made by an intern.

Who knows. It could be a huge XML file for the whole thing, and a test or human review in staging could easily miss that some text went missing. There’s plenty of bad right now, so I get the paranoia, but they say this was a mistake, they fixed it, and I’m inclined to believe them.

They emailed me. "When updating the site to reflect our constitutional scholars’ analysis of the impact of the latest cases on Article I, Sections 8-10, the team inadvertently removed an XML tag. This prevented publication of everything in Article I after the middle of Section 8."

I hope you update your security measures and check the digital footprint. Maybe you should hire #Anonymous to make your servers more secure. Seek out the best hackers if you want to prevent a "coding" error. But good attempt to cover for DOGE.

There’s no code involved. It’s text (even though it’s HTML). Someone edited the text. Who edited it? Why?

Looking at the source it has the hallmarks of a generated document (extra newlines, extra nested paragraph elements, empty elements) so it's plausible someone changed the code that generated the page from the canonical source and screwed things up.

Hand-edited XML without any lint or syntax verification. Still not coding, though terrifyingly reminiscent of the early 90s before everyone decided that XML was an error-prone performance pig and a disaster.

I guess everything nowadays is generated by LLMs, so they've probably tried out the new "constitution model" and it misbehaved. That'd at least be a far better "explanation" than just pretending it to be a coding error.
