The right answer depends on what your contract says. I know for the academic side, I've seen contracts have the copyright go to the publisher, but in turn, publisher agrees to enforce it on behalf of itself and the author.

Then at some point, when the Publisher may feel it's not worth its time and money, they will let the copyright revert back to the author to do with whatever they wish.
