In a trial, prosecutor has to prove money spent was outwith the remit of the donation Courts in for a few weeks of donors testifying 'The money donated was spent in the ethos that motivated me to give £*' Hour after hour, day after day until the prosecutor concedes the point. Then the case collapses
The Crown has to prove criminal intent. Money spent on a motorhome (and sundries) for use in a referendum campaign is effectively evidence for the defence. Money moved in-house for budgetary reasons is not criminal. 4 years! What happened to the overriding principle of fairness to the accused.
Donors aplenty willing to give evidence would effectively gum up the case and the court indefinitely. As I said when the prosecutor concedes the people that gave the money don't have an issue, the case collapses. Scot Police expected an easy fit up didn't and now in a corner with no pot to piss in.
