Open defiance of the courts continues Federal judges need to start holding officials in contempt or it will only get worse
Open defiance of the courts continues Federal judges need to start holding officials in contempt or it will only get worse
Yes they do, and yes it will anyway.
Uh oh! Looking out! THEY RUN THE RISK OF ACTIVATING CHUCK SCHUMER!!!!
The won’t. This country is dead.
America has judges and other judges?
Haha, don’t make me laugh. Courts are powerless AND for every court that would go there, there’s another that would reverse it. Rule of Law is a joke
I assume the spokesperson skates on her BS if DHS actually releases the guy (as they did).
They are defying everyone whose decision they don’t like: courts, Congress, federal depts and agencies, the majority of the country, their own base, the Constitution. Who will be the first to push back and put them in their place?
This was always going to happen. Can’t be above the law if you acknowledge or obey their rulings. It may start as a few trial attempts to evade court orders etc, but once they learn what to do it will happen every time.
Lawless authoritarians. See Article III, Constitution of the United States (if it still applies here in MAGAstan).

The idea that an Article I judge has more power than an Article III judge is silly
The implication is that the Supreme Court doesn't even have authority to rule.
The implicit executive power is greater than all explicit power
Nope bsky.app/profile/wool...
In fairness, they believe that because Trump-aligned interests paid very good money for their current slate of justices 😉 bsky.app/profile/prch...
If the law was "whatever the Executive Branch says it is," Abrego Garcia would still be in CECOT And I've never been worried about AI taking my place 😂 bsky.app/profile/carp...
Not just issuing them, but also enforcing them The judiciary's contempt authority is inherent. Nothing stops them from enlisting state/local law enforcement to arrest executive contemnors bsky.app/profile/yaju...
If SCOTUS blocks the arrest, so be it. That's how the system works Next time it happens, do it again. Force SCOTUS to block it again. Wash, rinse, repeat 2/2
Question: what difference will it make if we continue to force SCOTUS to block again and again? This is an honest question, not meant to be argumentative.
Sure, have Trump issue a pardon Next time they do something contemptuous, hold them in contempt again and force Trump to issue another pardon Eat his entire day issuing new pardons bsky.app/profile/thec...
We call this "resistance" and it's the minimum we should be engaged in
I think George Conway taught us that the illegal word is “contumaceous”.🤪 Although that may have been back when he was still explaining the *legal* news.🤭
Possible, but IMO it's more basic: judges are rooted in a centuries-long tradition of the government following court orders, and that metastasized into giving government attorneys and officials every conceivable benefit of every doubt all the time We're in a new world now bsky.app/profile/jmwa...
This is certainly the case for most.
Normally they'd rely on federal agents, but my assumption is Trump wouldn't allow Bondi to let that happen bsky.app/profile/sono...
Forces the contemptuous officials to endure the process every time, instead of getting a permission slip from SCOTUS to keep doing crimes bsky.app/profile/hera...
Couldn't Bondi be held in contempt then, and just keep doing so with everyone who fills her role until someone complies?
Goes all the way back to Coke. King James grumbled about it, but followed the law.
And they should continue, and expect now more than ever for this govt, especially under 47 to follow court orders. They should also know, and study case law when hearing any case by 47. If they don't, what's the point of laws if 47 can unilaterally break them.
Every bad thing he gets away with pushes some normies away from supporting him.
Refuse to accept Calvinlaw.
can contempt as coercion (as opposed to punishment) even be pardoned?
Unfortunately, the pardon power can be exercised in an extremely efficient manner, for example the J6 pardons.
BONUS: Come the next admin we’ll be rid of the pardon power forever.
Call the question and force the issue, so that people can see where things stand
Or... hear me out... They can just do what the dems are doing, giving up in advance, not even trying, because it would be a waste of their valuable time to actually fight for us, the nation, rule of law. *stares* contempt, bar complaint contempt, bar complaint one will stick.
Send a couple to CECOT in shackles, as an example to the others.
Well aside from pardon power (correct me if I'm wrong).
Criminal contempt can be pardoned. Civil cannot. I believe Civil Contempt can not only jail until orders are followed, but fines if set up right would still apply even when contempt is fixed. They can also, I believe, reach otherwise judgment-proof assets.
Does it have to be state/local law enforcement?
Doomers get the hook.
I'm sure Tricia has given it a lot of deep thought.
yep
John Roberts created a monster. It's about to eat him. The Supreme Court faces an existential dilemma of its own creation. www.vanityfair.com/news/story/h...
On the plus side, once we start sending these motherfuckers to prison I bet prison reform won't be far behind.
From my experience, EOIR IJs cannot hold anyone in contempt. Other than… you know… personal contempt… as in personal dislike.
The courts will make themselves irrelevant unless they start issuing arrest orders
That would've been Merchan. And that's why we're here.
Haul in Noem and keep her in a holding cell in an unnumbered holding cell in the Federal Courthouse until she complies. (If DHS files habeas, judge asks what cell number she’s in)
We need to start recognizing that the Republicans are preparing for a civil war and behave accordingly.
Do you think they’ll do that?
Yeah. That's the whole point. No one ever actually STOPS them, just waggles fingers. Why stop when there's no real world consequence? bsky.app/profile/gamz...
Check me, but immigration judges aren't Article 3 judges, right? Which should mean that yes a Federal district judge does in fact trump them.
Also, based on the SC's ruling on the Chevron doctrine, wouldn't a district judge be prohibited from giving an immigration judge any special deference?
Why do they keep mentioning the election? What is supposed to make that a magic talisman that overcomes the law, the constiution, common sense? Well people voted for him!! And? People were also okay with slaves, doesn't make it better. God King Emperor Cheeto McFuck Face still bound by law/rules.
Lawyers take the law so seriously. Lol. U guys must think its 2015. The law is whatever the executive branch says it is and u will like it. All these law books and precedents just flippantly tossed to the side. And u guys were worried about AI taking your place yet the worry should have been EOs.
Are you an AI?
Either way, that kind of doomer mentality is toxic. I muted em, bot or not
Nope just being snarky on a Friday that the DOJ is not listening to a judge and neither is the Department of State regarding passports.
bsky.app/profile/msnb...
Thanks for the update. Awesome news.
DOJ spokesperson is not listening. Remains to be seen whether that's empty bloviation. bsky.app/profile/chri...
small correction — that’s DHS spokesperson (who is awful and a serial liar)
Thanks, you are of course correct.
discredit where discredit is due
In contempt with immediate consequences. Like jail.
Honest question about this. Who is the judge holding in contempt? Would it be the lawyers who went in front of him? Or would it be the DHS officials saying they won't comply with the orders? (And boy I bet those lawyers do not want to come back in front of that judge soon)
It would be the DHS officials. Judges have another way to punish lawyers who file bullsh*t claims with the court - you might hear it called "Rule 11" because that's where it is in the rules of civil procedure. Penalties can be a small as a slap on the wrist all the way up to getting disbarred.
Update bsky.app/profile/moll...
What can we do about Supreme Court Justices who accept bribes?
