1. Blue slipping is stupid (generally). 2. That said it’s likely not unconstitutional because it falls within advice and consent parameters. 3. I like the blue slip in this context.

Not to mention the federal appellate and district courts are a creation of Congress. President gets to nominate officers to these courts, but Congress has a good bit of leeway in their makeup, and the Senate in particular given its unique role.
