Very few school shooters survive the attacks. They either take their own lives or are killed. The Parkland shooting prosecutor sought the death penalty but the jury deadlocked on the sentencing so he received life without parole. That could also happen with the UnitedHealthcare CEO.

It looks like the Tops shooter in Buffalo was charged with 1st degree murder under same statute which shows consistent treatment of acts like this in NY. He pled guilty and was sentenced to life without parole.

Assuming they pursue the death penalty if he's found guilty of the federal murder charge. They may choose not to pursue the death penalty. Too early to tell.
