The government brief even states that they have no authority to interrogate anyone except for aliens. NONE. Yet they cite this as their authority for doing what they are doing, which is profiling people who they don't have reason to believe are "aliens." That's illegal!

I’ve occasionally won a case on these grounds, though have not had the opportunity to try since Jan. In theory, more indiscriminate and collateral arrests should lead to more opportunities to raise 4th A objections.
"Interrogate alien or person believed to be an alien". In a place like LA, that could be over 70% of the population and in DC it's about 65% if you go by Homan's account of who is reasonably suspicious.
