nce 2017, the number of asylum applications in the UK has been increasing, by 2019 returning to levels seen during 2015-16 although the UK was relatively little affected by the European 'migration crisis’. This recent increase is likely due in part to movement to the UK by those already in Europe. • In 2019, at least 1 in 6 asylum applicants to the UK had made a prior application in a European country. • However, only a small portion of secondary movement across Europe is to the UK – in 2019, the UK produced just 6% of Eurodac hits relating to prior applications elsewhere in Europe. • While many entering the UK may travel through France, most top nationalities applying for asylum in the UK do not apply in France in large numbers (with the exception of Sudanese, Afghan and Albanian applicants). Social networks, shared languages and diasporas motivate asylum seekers to reach certain destination countries • Social networks aid migrant integration to society, acting as facilitators of information relating to life in the destination country. They are considered trusted sources and are likely to influence migration journeys more than information from formal institutions. • The presence of diaspora communities can motivate migrants to reach certain destination countries. The proportion of diasporas in the EU+ residing in the UK is correlated with the proportion of asylum applications across the EU+ made in the UK (see slide 21). Armed conflict, human rights abuses, poverty, political & economic instability and violence are factors that forcibly displace migrants • The majority (57%) of individuals escaping persecution are internally displaced within their own countries and most refugees displaced abroad stay within their region of displacement, living in countries neighbouring their countries of origin 1 2 . • Of the number of asylum seekers that reach Europe, only a small percentage claim asylum in the UK. Voting to repeal something is not at all the same as voting against it to begin with. I have not seen any sign of Democrats coalescing around the views that they will end all tariffs or cut ICE funding or even rescind the Big Horrible Bill's ICE mass deportation funding.

USA Today covers our study on immigrant crime reporting before the crackdown. My sense is that there's never been a time when immigrants, legal and illegal, were more concerned about interacting with law enforcement in this country. DHS believes that's a good thing!

Let's try to stop all violent crime because violent crime represents the most severe violation of someone’s rights. And it’s exactly for this reason that we should oppose mass deportation. It’s not just taking resources off the target: it’s only adding to the rights’ violations.

That’s because the Trump administration is trying to deport immigrants who report crimes. This is perhaps the most evil and counterproductive component of Trump’s mass deportation plan: if you care about stopping crime, you want immigrants to help!

We can see that police requesting legal status more frequently for immigrants through the U visa program. Notice the upward trend stopped under Trump 1.0, restarted under Biden, and unfortunately, it’s reasonable to expect a catastrophic change now…

We find that immigrants worked with police on more than 5 million crimes from 2017 to 2023, resulting in at least half a million arrests (only includes arrests within 6 months, known to the victim). Immigrants were helping law enforcement before the mass deportation crackdown.

NOT DONE YET: from 2017-23, before the recent crackdown has changed everything, the victimization survey shows that immigrants also REPORT VIOLENT CRIMES more frequently to the police than the US-born… even though we know many were scared to do so!

The media likes the immigrant-killing-American story way more than the reverse, but every time an immigrant is randomly attacked, it is likely they saved a US-born citizen from facing the same fate. If they weren’t there, it statistically would have been one of you.

Immigrants do commit crimes, even with US-born victims. But the data indicate that the reverse is more common: immigrants are more likely to be violently attacked by the US-born, lowering the rate of violent victimizations for YOU, the US-born citizen.

Robberies are the exception that proves the rule. It’s the one violent crime most likely to be committed by random people. Once we look at victimization rates where the victim knew the perp, we find immigrants again were HALF as likely to be victims of robberies!

The Cato Institute’s Alex Nowrasteh has shown immigrants are much less likely to be incarcerated than US-born. Countering skeptics, our paper shows that the immigrant/US-born gaps on violent victimization rates by known offenders align PRECISELY w/ gaps in incarceration rates!

We find that immigrants were 64% less likely to be violently victimized by someone they know OR by a family member than the US-born. Noncitizens (half of whom are illegal) were half as likely to be victims of violent crimes by people they know than the US-born.

Is this b/c immigrants are less likely to COMMIT crimes? Well, when victims are asked if they knew the offender, immigrants were significantly less likely to have known or seen the offender before, meaning the victimization rate by perpetrators immigrants know is even lower!

Pew finds that in 2023, 14 million "unauthorized" immigrants were in the US. BUT it finds that six million, or 44 percent, were actually authorized to stay here at that time. Trump has obliterated those protections and is trying to deport them all indiscriminately!

NEW— ICE vehicles chased a landscaping truck through Takoma Park, MD, on Monday about a mile from DC, which ended with the truck crashing on someone’s lawn and narrowly missing another car, multiple residents confirm to me. But here's the most horrible thing. Despite the court order in LA, there's been effectively no let-up in these types of profiling arrests nationwide. So ICE was told, "You're violating the Constitution in LA." It craters its operation in LA, but it just doubles down elsewhere!

When we look at street arrests in LA without criminal charges, convictions, or removal orders, the decline is even more extreme: 83% drop in these types of arrests since July 12. These arrests were previously almost unheard of in LA.

The government told the district court that it was not profiling. It explicitly said that its court order would not affect ICE's operations at all because it does not rely "solely" on the prohibited factors. In fact, they were lying about this.

New ICE data show that the court order banning profiling reduced ICE arrests in LA by 66%! In other words, ICE is effectively admitting that TWO THIRDS of LA arrests were unconstitutional profiling. Did they admit this to the court? NO! They lied to the courts...

The government brief even states that they have no authority to interrogate anyone except for aliens. NONE. Yet they cite this as their authority for doing what they are doing, which is profiling people who they don't have reason to believe are "aliens." That's illegal!

All these arguments are so dangerous because they basically say that the government can continue to conduct these stops and no one can stop them EVEN IF THEY ARE ILLEGAL. That's terrifying. And that might be exactly what happens

They also argue the court can't enjoin the govt because it applies to people other than the named plaintiffs. But since the govt is profiling people WITHOUT KNOWING WHO THEY ARE, there is no way to provide any relief except through an injunction that applies to everyone!

Overall, what the govt argues is more frightening than if it was just arguing for racial profiling. It starts off by saying it plans to deport 10% of LA & use profiling. But here it says no one illegally stopped can sue b/c they can't prove it's likely to happen again!

Unfortunately, a key part of the government's argument is that the district court's order threatens to upend this state of total impunity. This argument should be laughed off by any serious person, but given what it has already said about lawsuits against CBP, SCOTUS may find it most compelling! AH

There is another "remedy" for 4th amendment violations, which is the rule that allows for the exclusion of evidence obtained through an illegal search. But that constitutional rule doesn't apply to immigration courts and certainly won't be voluntarily applied by this regime.

But the DOJ says Muehler v. Mena, 544 U.S. 93 (2005) found otherwise, but it didn't at all. This was a case against state and local officers under 42 USC §1983, which doesn't cover suits against the feds AT ALL. And the person was not awarded damages. They are trying to deceive the court?

SCOTUS hasn't ruled directly on whether you can sue ICE agents, but multiple appeals courts have said even if ICE shoots you, you can't sue them. Here's the 5th circuit summarizing how these claims are all getting shot down. ICE agents also have near-total immunity.

SCOTUS has repeatedly said there are no damages for Border Patrol agents' unconstitutional conduct. A CBP agent beat up a small business owner at his business, not crossing the border. SCOTUS said that it would COMPROMISE NATIONAL SECURITY to let him sue the agent who illegally beat him up. 🤯

The Justice Department absurdly says that there's no reason to stop its racial profiling program because racially profiled individuals can sue for damages for wrongful CBP/ICE detentions. They are lying! And its citation does not remotely demonstrate it. CBP/ICE acts with near-total impunity.
