You may be right. I'm willing to hear it out. But I'm stuck on this idea that relying on good faith was the problem. On the contrary I think it's the only way to have a free and virtuous society. The breakdown was a moral/social one, and that can't be remedied by improving the language of the law.
I agree with the first half of yr comment: they don't expect people to keep acting in good faith after they themselves stop. Instead, they expect they'll be able to force the general public to comply with the system (where before it was mutually voluntary). I don't think they're right but we'll see.
I don't know if it's a flaw in the Constitution, but it's a flaw in human cooperation. A government made up of separate, co-equal parts will only run on good faith. It's possible that this type of abuse cannot be prevented by getting the words more right: in truth it's a failure of the human self.
