Steve Smith (@stheman.bsky.social) reply parent
Indeed. Rights are something that a court is supposed to determine, especially since those are limitations on governmental power. The popular branches are supposed to stay out of that sort of thing.

You shut up.
Steve Smith (@stheman.bsky.social) reply parent
Which is funny, since I don't follow Jesse Singal.
Steve Smith (@stheman.bsky.social) reply parent
For a political party that is ostensibly in the business of winning elections, getting ahead of the public on "rights" has been a ticket to defeat for the last half-century.
Steve Smith (@stheman.bsky.social)
Much of the discussion gets tied down in rights-talk, which has been a cancer on the Democratic Party since 1972. For all the talk about how rights are "inalienable" or "god-given", the fact has always been if the courts are unwilling to recognize a right, the public isn't going to lead the way.
Stephen Robinson (@playtyperguy.com) reposted reply parent
I think the dilemma is if you end up with LBJ or Goldwater. MLK isnāt on the ballot. Even Lincolnās positions on slavery were not extremely progressive in 1860. Protecting trans rights will require proving that itās an issue Dems can win on. Otherwise, weāre in big trouble.
Steve Smith (@stheman.bsky.social)
The whole point, obviously, is if they can't win, they can't do anything meaningful to support your rights; an "ally" who isn't in power isn't a useful ally.

Newsom: We got here because the President is struggling. We got here because the President is one of the most unpopular presidents in U.S. history. We got here because he recognizes that he will lose the election.
Steve Smith (@stheman.bsky.social) reply parent
If public entities arenāt making those decisions, that allows for private actors and organizations to freely discriminate. Not sure if that sort of libertarianism would be much of an improvement for trans.
Steve Smith (@stheman.bsky.social) reply parent
Heās driving the President nuts, and heās fighting him on issues voters care about, while not obsessing about trivial matters.
Steve Smith (@stheman.bsky.social) reply parent
No, I said it was a bad analogy because it was improbable that a candidate who supported reversing the 13th Amendment could win the Presidency, in large part because it involves an existential threat to a statistically-significant group.
Steve Smith (@stheman.bsky.social) reply parent
I believe Newsomās very healthy hobby is leading the opposition to Trump.
Steve Smith (@stheman.bsky.social) reply parent
That is true. We elect people to make those decisions
Steve Smith (@stheman.bsky.social) reply parent
In fact, they do exist.
Steve Smith (@stheman.bsky.social) reply parent
I did not say that
Steve Smith (@stheman.bsky.social) reply parent
But the fact that we have separate categories for menās and womenās sports is a type of separate but equal policy, to which we are allowed to establish certain rules and regulations
Steve Smith (@stheman.bsky.social) reply parent
If the courts donāt believe that a right is affected, then the alternative is to go to public opinion, bend the knee to the majority, and make a case as to how this policy benefits everyone.

Iām only an ally to those who want to win. āAllyshipā concerning trivialities has been a cancer on the Democratic Party.
Steve Smith (@stheman.bsky.social) reply parent
Weak analogy. I don't see how a candidate who proposed re-enslaving Black people could win the nomination, much less beat Trump; Black people make up a statistically significant portion of the electorate, and slavery is existential in a way that swimming against biological women isn't.

The post-election polls showed that Trump won even more decisively with eligible non-voters than he did with the actual electorate. And the votes Harris lost vis a vis Biden in 2020 were disproportionately from the conservative/moderate faction of the party.
Steve Smith (@stheman.bsky.social) reply parent
Sportsball is a trivial issue, and even on that he hasn't used his power as governor to do anything to limit trans participation in sports.
