The excuse of "I was following orders." Does not apply when troops follow unlawful orders. The UCMJ states that it's the responsibility of all federal military members to disobey unlawful orders.
Agree National Guard is the States' militia & Governors cannot send them to another State without an agreement nor can DOJ order it. However, they can be federalized as part of the US Army, thus governed by the Constitution, Posse Comitatus Act & UCMJ. All ranks can be held personally accountable.
