We just prevailed in our case against Trump's massive IEEPA tariffs, in the Federal Circuit! All challenged IEEPA tariffs ruled illegal, but scope of injunction TBD. Will have more to say later. Here is a link to the ruling (7-4 decision by en banc court): www.cafc.uscourts.gov/opinions-ord...

Very true! Also once a grand jury realizes it can do this, it may be hard for it to stop. Most regular grand juries are monthly, but the specials and additional are 18-36 months long, so they’ll be around. Also you can’t “game” the selection of grand jurors. In SDNY there were no “strikes.”

Once prosecutors hear that a given grand jury rejects indictments, they might bring future indictments to a different grand jury. This also assumes that the AUSA did not signal to the grand jury that the case should not be charged. Although that would be unusual, lots of things are unusual here.

Declaring a fake emergency as an excuse to deploy the military to police civilians is one of the most canonical examples of authoritarian takeovers. Overseas, people see clearly what Trump is doing. Here in America most people — especially those with power or influence — are in denial.

This is a huge difference. Large portion of NYC apartments are rent stabilized and those apartments have annual rent increases and bigger increases when they are renovated between tenancies.

In urban policy, it is considered bad for someone to be rent-burdened (spending at least 30% of their income on rent). But Cuomo's newly proposed law would *require* that people be rent-burdened. Absolutely insane.

S.Ct in Riverside v. McLaughlin says that “[w]here an arrested individual does not receive a probable cause determination within 48 hours, … the burden shifts to the government to demonstrate the existence of a bona fide emergency or other extraordinary circumstance.” Weekends aren’t an excuse.

They could, as a moral statement, but federal agents cannot be required to comply with such a state law. If a federal agent were arrested for not complying with the law, the case would be swiftly removed to federal court by the agent and then dismissed.
