1/ I worked at DoD. I literally cannot imagine lawyers coming up with a legal basis for lethal strike of suspected Venezuelan drug boat. Hard to see how this would not be "murder" or war crime under international law that DoD considers applicable. Read expert analysis by @bcfinucane.bsky.social⤵️

It's become clear that this administration is just a protracted war on anybody who's read a book without pictures in it. It's a miracle we're all still getting up and going to work every morning. The psychological drain is the point, and I'm increasingly grateful to the people who are still decent.

Per Mike's thread in order for a company to protect itself so they can do their job they need broad licenses just because case law has not developed the specificity needed to write narrower terms that have high confidence of sticking.
But as soon as they take an identified image and use it to update the ML filter, they need a training license. The mass infringement of LLMs has poisoned a lot of legit ML applications, and it's going to be a long time before case law catches up (if it ever does).
IANAL but it seems to me as soon as you have a trust & safety human in the loop reviewing CSAM findings, and feeding tweaks back into the system to improve it, you are arguably using user data to train your ML and need a license.
