Substantive due process is a solid tool against an authoritarian government to maintain freedoms. Conservatives want to use it to circumvent environmental regulations, consumer protections, etc. But used as an argument against SAVE would force them to embrace or abandon Lochner.
Conservatives love Lochner's "substantive due process," i.e., the idea that the Fourteenth Amendment's Due Process Clause not only protects individuals from unfair procedures (procedural due process) but also from government interference with fundamental rights, even if the procedures are fair.
SAVE is certainly a de facto poll tax, but not de jure. Any constitutional review would be based on an "undue burden" on voting. This SCOTUS would not strike down SAVE on those grounds. An interesting argument would be substantive due process under Lochner v NY, (1905) which has not been overruled
IMO, it's a personal choice of expression. Some people (women and men) don't like their last name (for many reasons) and choose their spouses' last name. Some choose to hyphenate. I celebrate people who have chosen their form of expression. (I'm looking at you, young people. Cheers to you.)
I also recognize the increased burden SAVE places on women and a passport is not financially feasible for many budgets. I merely point out this loophole for those who have passports. SAVE targets women who are poor or of color; i.e., women whose votes have defended democracy for several elections.
I agree 100%. However, a passport is sufficient documentation substituting for a birth certificate for voter registration. Therefore, for those out there whose passport matches, they can register and/or re-register. SAVE abrogates the 19th amendment and is voter suppression of women.
