This is an interesting argument. Looking forward a bit, if LLM output is speech, would it be treated the same as malware when it causes harm? Like "yes, the code itself is protected speech, but when you use it to drain someone's bank account, that part isn't protected."

Elections ought to be close over time. Parties aren't static; the losing parties should adjust their message to appeal to a broader coalition of voters until they can get to 50%. If both are doing that, you get close elections. The electoral college just warps what "50%" means.

When you say "I won't answer any questions until I talk to my lawyer," the cops' next move isn't to give you a phone to call "your lawyer." It's that questioning then must stop until you either hire a lawyer, or one is appointed to you. The main impact is to end the questioning.
