I'm sure at some point there will be more details about what it is with the 16 states and the legal requirement with them only. Virginia may have a republican Governor, for now, but our legislature could hopefully take care of whatever law related problem has caused this
Most of the issue is current lack of ACIP authorization for the new COVID vaccines in the vaccine schedule (committee is in disarray). But don’t be surprised if health insurance providers start using this as air cover to deny coverage.

I live in MA and definitely cannot schedule. CVS is not taking appointments for the new vaccine here.
CVS is scheduling them in New Hampshire and Rhode Island. We're booked for one in Nashua, New Hampshire. Fortunately the states are small and close together out here.
Be sure to check your insurance coverage. Not all plans work for out-of-state pharmacy vaccinations.

The reason is that these states only allow pharmacies to dispense vaccines recommended by the Advisory Committee on Immunization Practices (ACIP). This used to be done routinely at the same time as the FDA approved them, but everything's a mess this year due to RFK Jr firing the whole ACIP in June.
FDA approval makes it legal for them to be injected into humans, ACIP approval is what makes them routine, available at pharmacies, generally covered by insurance, etc.

The problem isn't the restricted FDA authorization. The problem is a second gateway, authorization by the Advisory Committee on Immunization Practices. ACIP approval is what makes them routine, dispensed by pharmacies, usually covered by insurance. RFK fired the whole committee in June and replaced
them with his own picks, including known vaccine skeptics. It won't meet for another three weeks, and when it does it won't necessarily approve them. Senator Bill Cassidy wants the meeting indefinitely postpone, so it might not even meet.
