We only learned they moved Abrego Garcia out of CECOT after he met with Sen. Van Hollen, what’s to say they haven’t moved others being held to other places as well? Why would you limit the proposed subclass to CECOT when you have no way of knowing if the plaintiffs are even still there?

You have to have at least one named representative member of a class. The problem with adding everyone is you would practically concede that the class isn't. So large that individual suits aren't practical, thus failing the requirements of FRCP 23. www.law.cornell.edu/rules/frcp/r...

I know that. But limiting to CECOT only seems potentially problematic, because if they move the named plaintiffs to another prison (or if they have already - we just don’t know) they’d no longer be representative of the proposed subclass.

Standing is determined at the time of suit. Moving doesn't change that.

Right I forgot that. My point is that it’s a black hole of information and we don’t actually know if everyone sent there, including the named plaintiffs, are still in CECOT now. We still don’t even have the names of everyone sent there. Description by location struck me as odd given the lack of info
