Doesn't this give rise to a tort claim for false imprisonment & intentional infliction of emotional distress? Also a habeas corpus violation.

Here you go again with pesky facts and logic.
It would be nice if there was someone who could actually hold these "thuggish" Republicans accountable for something. I know, I'm dreaming.
Dude… the legal system is no longer valid. They now decide what is legal based on preferences.
then now is the time to strike, since we severely outnumber them.
In Texas they do, but most states are normal and call the opinions as the court sees them..Dem or Republican have lost in both, but no Dem wins in Texas..they are corrupt which shows in the polling as the 2nd most important FACT that Texasans think about and they don't like that either.
Until this year..1/4 of Texas approves of the state legislature as of June 2025, and they buried themselves with this stunt..almost half of Texas approved of the legislature in February..they are dying fast!
These maps are going to bite them in the ass as 2 of the 5 Districts are clear Dem wins, and purple is the color Texas!
That attitude helps no one. Just hand in your inmate card now.
If you keep acting like there is no law there certainly won't be. We have to expect law to be followed, period. We can expect it wont be but we can't just give up on the concept entirely.
nonsense
hmmm, who will enforce any court order releasing her....if she can get one from a state or fed judge?
Do the imprisoners have guns there? I imagine other folks can come and go, so if her attorney got a restraining order, she likely could leave with her attorney (IF she is using one).
the presence of corruption and illegality doesnt invalidate the legal system it beseiges the legal system, sure. but the legal system is in fact its own remedy to this problem
i agree
Texas, enslaved people were officially freed on June 19, 1865, which is now known as Juneteenth! And kidnapping can be a federal charge in any state!
The AG of Texas is Ken Paxton who is likely giddy this is happening. The idea of laws still being in place is nice, just not reality, or she’d not be detained there in the first place.
The system is mostly holding. Especially in lower fed courts.
lots more danger to come, Im sure But I do have faith that it can withstand the social order is precarious though, given the Musk/Theil, Fox, far right provocateur nexus..or whatevr you want to call it
We'll need to stick together and keep working.
With this supreme court the legal system is crumbling, or more accurately rotting from the inside...
She wouldn't be arguing this to the Supreme Court (although I imagine TX courts might not be much better).
there has to be some kind independent oversight of scotus. investigative whistleblowers bringing cases before the people’s court of public opinion. or we could have term/age limits like we do for other things. what’s the plan because it’s/will be a talking point
Indeed, i mean looking in as an outsider I'm confused as to why anyone thought politically appointed judges was a good idea in the first place
how would u identify this rot? how do you measure it? Perhaps this is just another turn in the lifetime of Law's haunted halls. perhaps in the end we'll see this as facing its demons in full form & evolving into something better, stronger. the likelihood of each our theories are at least the same
I applaud your optimism on the future and I hope you're correct. As a Brit I'm looking in as a concerned observer but the combination of this sociopathic president, this supreme court, the escalating gerrymandering and the race to the furthest possible extreme within particularly the GOP is ominous
It is extremely ominous. All the more reason to stand for the light. As a Brit, respectfully, you must know this well... "We shall never surrender."
Indeed, i think certainly in Europe we are more aware from bitter experience of the dangers of authoritarianism and particularly fascism. It does seem that many in the US are making the same mistake made in Europe in the 30s by either being complacent about or actively appeasing fascism
This is a cultural change that began with Reagan in the 80s. The strides made during the civil rights era had the conservatives cowed to some degree.
I dont know if it helps, but it seems facing this monster head on was pretty much inevitable. Wouldve been nice if it wasn't such a fn scary thing to face, and it didnt feel like all that is strong of goodness hasnt been infiltrated by the forces of evil...but we were maybe made for this moment...
She needs to do this but then sue. Bc it will cost her money to Go to court
If the law is not enforceable or is willing misinterpreted it is not nonsense.
Have you seen what SC(R)OTUS has been handing down lately?
life is scary and doing good can be treacherous doesnt mean we run from the demons...no matter how many of them amass
Nonetheless, as Mr Kuba said, the legal system is no longer valid. We cannot rely on it to render impartial, trustworthy orders, yet society must continue toward a more perfect union. Things fall apart; the centre cannot hold; Mere anarchy is loosed upon the world… —W.B. Yeats
If youre gonna quote Yeats for this then you might as well say it was never valid. Fact is, this has been the struggle since the beginning. And, in the past, when laws came down that were not faithful to the constitution and its purpose, what fixed it? The legal system. Dont give up the hill.
What did she do that she needs police surveillance??
Its to prevent other democratic lawmakers in texas from doing what the house is doing. They fled the state to guaruntee there is no possible chance the gerrymandering laws can be forced through, and for so long as they remain outside of texas state lines, theres not a damn thing anyone can do.
"legal system is invalid" == nonsense
During the first special session, Collier (and others) broke quorum, which the Texas Constitution allows. MAGA is angry and embarrassed by that, so they are threatening repercussions if the Dems don’t quietly accede this time.
The only power the system has is a monopoly on legalized violence.
They now decide what is legal based on interpretation of the law. (But you are not wrong. Same thing.)
I think you can add extortion to that list.
Wondering about that too? It's a civil warrant. Seems way overboard.
No, because she is not literally “locked in.” As I understand the situation, they told Collier she would be arrested if she left without agreeing to a DPS chaperone, so she sat down. The mere threat of future arrest isn’t “restraint” or “confinement.”
I mean, not by strict definition but for all practical purposes…
The guy asked if there was a tort claim, and there’s not if Collier wasn’t physically prevented from leaving and chose to stay rather than test the threat of arrest. Clearly, it was a savvy political move by her—the publicity has been priceless. I’m just saying it doesn’t appear tortious.
Totally. But will you admit that they are probably but almost definitely NOT bluffing? They have proven time and again over the last 6 months that they will weaponize the “justice” department and use lawfare to hurt anyone who stands up to them. If Dr. Lector said he might eat me…he might not…but
I don’t know if they’re bluffing, but neither does she. That’s the point. You don’t know if there’s a boundary unless you test it, and don’t ever comply in advance. What I do know, is that those who have stood up to MAGA overreach consistently win (see, e.g., Perkins Coie).
Let’s hope that continues. I’m getting nervous.
It's straight up kidnapping.
And abuse of power. And assault and obstruction and infliction of bodily and mental harm. The list goes on.
Texas Penal Code Title 5. Offenses Against The Person Chapter 20. Kidnapping, Unlawful Restraint, And Smuggling Of Persons Sec. 20.01. (1) "Restrain" means to restrict a person's movements without consent, so as to interfere substantially with the person's liberty
on one hand: yes, absolutely. on the other hand: she lives in a place without a functional government. So we'll see.
It will do if everyone goes down there and makes them enforce the laws. If we don’t, we don’t have a county.
Extortion. Kidnapping. Threat of force. Denial of due process. Denial of even basic living conditions. Even mass murderers get beds.
In a nation with a rule of law you’d be absolutely correct. Unfortunately, that’s not the nation you live in.
