Lethal force against a civilian vessel in international waters is a war crime if not in self-defense. If not in self-defense, only non-lethal actions, such as warning shots or disabling fire, are allowed. "Not yielding to pursuers" or "suspected of carrying drugs" doesn't carry a death sentence.

this is almost certainly under Title 32 authorities (meaning the TX guard will be nominally under TX state control but on a federal mission), meaning the posse comitatus issues that came up in California will not apply. that said, it raises a whole lot of other legal problems

When President Trump used 32 U.S.C. § 502(f)(2) in 2020, that was to have out-of-state National Guard troops sent to D.C.—which has no sovereignty of its own. Sending the un-federalized TX National Guard into IL without the latter’s consent raises *serious* Article IV problems that 2020 … didn’t.

Re the enabling of Trump's claims I don't know if justices in majority recognize that Trump isn't just fighting the Constitution he's fighting against the 1689 prohibition of dispensing and suspending and Magna Carta and the 1215 prohibition of blessings for trial by ordeal

The Trump admin is now moving to effectively double the number of immigration judges by citing flimsy legal authority to deputize hundreds of totally inexperienced military lawyers to take these jobs. Notably, immigration law is infamously complex, often described as second only to tax law.

As a voter in Chicago Illinois during Carter Reagan Bush 51 and Clinton, I figured I was voting for local leaders like Mayor Harold Washington or state senator Obama to deal with roads schools policing etc And voting for federal officials to deal with Medicare Social Security and nuclear weapons

Suggestions from someone who lived 20 years in Chicago 1) per our Constitution voters in Illinois + city of Chicago chose elected officials who are responsible for schools roads policing etc; you and I, voters elsewhere, chose federal officials who are responsible for Medicare + nuclear weapons

For those asking why Judge Breyer stayed the ruling, the answer is because, if he didn't, someone else (the Ninth Circuit or #SCOTUS) would have, at least temporarily. I know it's frustrating, but the stay is designed to avoid provoking either a less-sympathetic Ninth Circuit panel or the justices.
