K, GWOT isn’t a blanket authorization to use *unprovoked* deadly force anywhere in the world. The AUMF *might* authorize interdicting the boat & *if* the crew started, say, shooting at a helicopter or something, it could *then* authorize self defense. But that ain’t what this looks like right now.

1 Our good colleague apparently enjoys bombast for law—wielding rhetorical flourishes about Napoleon’s alleged digestive wisdom. But it is one thing to observe that soldiers need food; it is quite another to stretch that battlefield maxim into a statutory command Congress never enacted. The statute prohibits “material support” to terrorist organizations, yes—but it does so in the particular ways that Congress enumerated. The dissent, unfazed by textual restraint, wants to read “meals” into the statute as though judges have the freedom of grocery clerks who can stock the shelves of statutes as they see fit. But Congress chose specific terms; judges are not free to supplement them because Frederick the Great talked about his dinner. To say that every provision of food is support for terrorism is to collapse the statute into absurdity: under the dissent’s theory, a soup kitchen feeding the hungry—some of whom may be unsavory characters—would find itself guilty of aiding terrorism. That’s not textual fidelity; that is judicial overreach. Nonetheless, the dissent accuses the majority of policymaking. The irony is rich. What the dissent proposes is not interpretation of law but enactment of a new one—that makes for a stirring read but it’s not what Congress wrote.

Post-OKC, the government did a really good job of making it difficult to mix/cook effective high explosives. If you can find a recipe to make an explosive & you can get all of the stuff to do it, odds are that 1. it’s really dangerous to for you to proceed &/or 2. the end result probably sucks.

Dershowitz, who no one disputes is a public figure, haspresented no evidence that CNN’s commentators or producersacted with actual malice. To begin, CNN has offered unrefutedevidence that its commentators believed in the truth of theirstatements about Dershowitz; all of the journalists testified thatthey believed their statements were fair and accurate. AndDershowitz did not counter that evidence. Instead, he repeated aboilerplate objection that the testimony was “scripted and self-serving.” Probably so. But that does not render it non-probative,and in the absence of contrary evidence, questioning the witnesses’ credibility is not enough to create a factual dispute. See Penley v.Eslinger, 605 F.3d 843, 853 (11th Cir. 2010).

There’s a general trade off with explosives—sensitive explosives are not powerful, powerful explosives are not sensitive.* The way around this is an explosive chain that builds in power. For the safety of troops, fuzes USUALLY break that chain until they’re fully armed. *some exceptions apply

It got almost everything *wrong,* but EOD technicians are deeply split on The Hurt Locker. OTOH, there was a British series from like the 80s called “Danger: UXB” that positively *nailed* some WWII-era bomb disposal procedures.
