I do not think it's a very good argument, even if the facts are as stated. I have no idea whether the facts are as stated. Ultimately (and unfortunately) there's not really anyone positioned to do anything if they're not. That would have been true under other administrations as well.

Tom Nichols is correct. The administration's argument will be that they were members of an international terrorist organization and therefore can be treated as, in effect, combatants. And this is not a new argument. International law is messy enough that it is likely a non-frivolous argument.

I was thinking about a possible Illinois v Texas direct to SCOTUS case earlier today. Making that option more plausible and more interesting: Thomas and Alito always dissent when the Court declines such a case, on the grounds that they believe the constitution requires SCOTUS to hear such cases.

Lethal force against a civilian vessel in international waters is a war crime if not in self-defense. If not in self-defense, only non-lethal actions, such as warning shots or disabling fire, are allowed. "Not yielding to pursuers" or "suspected of carrying drugs" doesn't carry a death sentence.
