What purpose this kind of thinking serve in the current situation? Sunstein manages to minimize the wanton destruction of agencies created by law as raising separation of powers issues. For him, the important thing is that no one raises their voice when discussing burning down the government.

Seems to me this argument applies to all those dismissals from agencies where Congress protected the incumbents from political pressure. Also, would Congress have created agencies at all if they could be controlled by the President? The point of agencies is to apply experties, not politics.

This analysis assumes Congress would empower the President to run agencies directly. Would Congress give the Fed the same range of power if I knew the President would get hold of that power? The presumption should be that it wouldn’t. Therefore the statute should be struck down.
