Seems to me this argument applies to all those dismissals from agencies where Congress protected the incumbents from political pressure. Also, would Congress have created agencies at all if they could be controlled by the President? The point of agencies is to apply experties, not politics.
I think the problem is that John Roberts and the Fash Five don't care about law, and there's nothing we can do to make them. The only solution is impeachment. Maybe if there's enough outrage over the rule of law rather than individual decisions we can get our Reps to do something.
This analysis assumes Congress would empower the President to run agencies directly. Would Congress give the Fed the same range of power if I knew the President would get hold of that power? The presumption should be that it wouldn’t. Therefore the statute should be struck down.
