Yes that makes sense as you would have to account for the size of the bullets as well, but these metrics are actually related to the lethality of the weapon in ways that the inclusion of grip attachments is really not.
Michael Anderson (@michaelander45.bsky.social) reply parent
What i will say is that they both are right about how dems draft these bills which tend to come down to cosmetic style features that have no relation to lethality.

Michael Anderson (@michaelander45.bsky.social)
I wanted to circle back to the underlying hypo here and why guidance counselors having an independent duty is not a sufficient differentiating response. The key idea is that imposition of that legal duty is allowable under the first amendment and as such we cannot foreclose a similar duty wrt AI
Michael Anderson (@michaelander45.bsky.social) reply parent
Bad as in worse than the alternative? Because Iām skeptical there, or think the difference between them is small enough to take the gamble that the shutdown leverage play forces some kind of change.

Michael Anderson (@michaelander45.bsky.social) reply parent
Yeah search is probably the closest analog and personally I dont think you could call the results the "speech" of the company but YMMV
Michael Anderson (@michaelander45.bsky.social) reply parent
Yes it's not random, BUT the explicit output of any input prompt cannot be attributed directly to individuals or groups given the probabilistic nature of the operation.
Michael Anderson (@michaelander45.bsky.social) reply parent
Programatic interaction is demonstrably different than real-time interactions that are completely unbounded
Michael Anderson (@michaelander45.bsky.social) reply parent
Ugh get well soon sir
Michael Anderson (@michaelander45.bsky.social) reply parent
Im not sure it will matter as a legal matter, but in any non gen-AI case the relevant text itself can always be directly attributable to an individual or group of individuals under the control of the enterprise. This is expressly not possible with the LLM probability machines.
Michael Anderson (@michaelander45.bsky.social) reply parent
No the fact that the technology is directly interactive and responsive DYNAMICALLY to the user is a key difference. The kid showed it a picture of the damn noose he tied!!
Michael Anderson (@michaelander45.bsky.social) reply parent
In a very generic sense the reinforcement training steps post self training do cause it to behave like a "chat bot" but it is not in any specific sense directing cognizable outputs.
Michael Anderson (@michaelander45.bsky.social) reply parent
"*in accordance with the expressive inputs of the devs*" seems to me to not be an accurate description of how these systems work at all on a technical level.
Michael Anderson (@michaelander45.bsky.social) reply parent
NO, how is that at all equivalent to a random person encountering a minor on the street in the hypo above. Now maybe if you aggressively marketed the game to at risk kids and include copious detailed instructions for how to actually kill yourself you may have some issues.
Michael Anderson (@michaelander45.bsky.social) reply parent
The problem there is regarding gender-affirming care as equivalent to inducing a child to jump down a well. If you believed that (and you shouldn't !!!) than the equivalence makes sense. It's like how people believe abortion is murder and the normative implications of that belief.
Michael Anderson (@michaelander45.bsky.social) reply parent
Intent can be inferred and it would at least be manslaughter
Michael Anderson (@michaelander45.bsky.social) reply parent
Thats MURDER plain and simple
Michael Anderson (@michaelander45.bsky.social) reply parent
I guess I dispute the implicit stance that the LLMs are not a "technical tool"
Michael Anderson (@michaelander45.bsky.social) reply parent
Agreed, I think one big problem here is analogizing these things to books is a categorical mistake. We know that 1st amendment doctrine considers factors like imminence and foreseeability of harm in certain contexts and given that, the interactive and real time nature of the product is important IMO
Michael Anderson (@michaelander45.bsky.social) reply parent
Why is that different for the guidance counselor? If his ideas are that teenagers should be able to kill themselves if they want. If you make a product that will reliably generate these āideasā in response to foreseeable user prompts I do not think it is equivalent to a book advocating for suicide.
Michael Anderson (@michaelander45.bsky.social) reply parent
And corporations have legal duties regarding safety and efficacy of their products
Michael Anderson (@michaelander45.bsky.social) reply parent
It does not convey independent ideas. It generates responsive text to the user provided prompts. Further, if it came out that a student guidance counselor was giving the same āadviceā as chatgpt here that person would be in super deep shit.
Michael Anderson (@michaelander45.bsky.social) reply parent
Also I dont think āopposing political beliefsā is a useful marker to get at the underlying dynamics here.
Michael Anderson (@michaelander45.bsky.social) reply parent
Yes!
Michael Anderson (@michaelander45.bsky.social) reply parent
I think the issue is what āopposing political beliefsā means to each group and its not exactly an equivalent marker. Eg if you asked explicitly about cutting off for views on taxes the result would be vastly different.
Michael Anderson (@michaelander45.bsky.social) reply parent
Yeah it's a big worry! If you look at Chicago for example the only patches of red Trumps votes are where the Police officers live š¬
Michael Anderson (@michaelander45.bsky.social) reply parent
Not the model but the generated outputs or next sets of inputs. Eg they are not real time changing the weights.
Michael Anderson (@michaelander45.bsky.social) reply parent
Well we have not idea how it will be framed or moderated as right now all we know is its existence from one person contacted to participate.

Michael Anderson (@michaelander45.bsky.social) reply parent
