Italy is doing something interesting with it's admission to medical school. Anybody with a high school diploma can enrol for the first semester (actually two months of intensive all day coursework). They take three course: Chemistry, Biology, and Physics. Mostly taught remotely.

Yes that makes sense as you would have to account for the size of the bullets as well, but these metrics are actually related to the lethality of the weapon in ways that the inclusion of grip attachments is really not.

I wanted to circle back to the underlying hypo here and why guidance counselors having an independent duty is not a sufficient differentiating response. The key idea is that imposition of that legal duty is allowable under the first amendment and as such we cannot foreclose a similar duty wrt AI

Im not sure it will matter as a legal matter, but in any non gen-AI case the relevant text itself can always be directly attributable to an individual or group of individuals under the control of the enterprise. This is expressly not possible with the LLM probability machines.

The problem there is regarding gender-affirming care as equivalent to inducing a child to jump down a well. If you believed that (and you shouldn't !!!) than the equivalence makes sense. It's like how people believe abortion is murder and the normative implications of that belief.

Agreed, I think one big problem here is analogizing these things to books is a categorical mistake. We know that 1st amendment doctrine considers factors like imminence and foreseeability of harm in certain contexts and given that, the interactive and real time nature of the product is important IMO

Why is that different for the guidance counselor? If his ideas are that teenagers should be able to kill themselves if they want. If you make a product that will reliably generate these ā€œideasā€ in response to foreseeable user prompts I do not think it is equivalent to a book advocating for suicide.

I think the issue is what ā€œopposing political beliefsā€ means to each group and its not exactly an equivalent marker. Eg if you asked explicitly about cutting off for views on taxes the result would be vastly different.
