Yeah its pretty obvious this didnt happen by accident, but its normal stuff for defence lawyer... The strongest argument they have is that Finland dont have the right to prosecute crimes in international waters. I think the guilt is proven but is it Finlands authority to judge remains to be seen.
That’s why I raise the notion of ‘High Seas’-there are international laws to be observed and you can’t do just what you like in international waters-if Finland is ruled not to be the right legal system for judgement this will be a slam dunk in international courts
But then it would be the shipping company resposible yes? This court is deciding if the crew are criminals of serious vandalism. So if the court decides its not for Finland to rule these crewmen would avoid being prisoned and criminally charged?? Does international sea court rule for jail time?
I think in the past it ruled the death penalty-maritime law is one of the oldest-I’m not an expert but I don’t think it’s not an option
Now the lawyer argued that Eestlink 2 provided electricity from fin to estonia, so cutting the cable actually didnt cause any harm to finland when we had more electricity supply because of it :D therefore it is not a crime since the reguirement for causing harm is not fulfilled :D Funny lawyer.

I think the crew is guilty number one because they did the crime. If the crew testifies that shipping company gave the orders, we will have guilty number two. The crew hardly has any change to get rid of this or otherwise it means that international piracy is silently allowed.
All ships have to be registered to sail under a country flag so I would expect that country to be held responsible or partly responsible at least
I'm not an expert but I guess the responsibility is limited to the shipping companies which usually are private owned. Usually costs of real accidents would be covered by insurance companies but I would not be surprised if this ship is sailing without a proper insurance.
i think this one is more legitimate than some other russian vessels, since it is registered in Cook islands thats under New Zealand and King charles is state head :D So i guess they have more regulations than some other poorer countries? But its just a guess.

International maritime law is not managed by countries so country of registration/flag confers responsibility but not jurisdiction-these laws go back to at least the 15th C when France, England, France, Spain & Portugal were sailing around the planet & having wars & piracy

I think there might be some interesting references to airline terrorism as I think flights follow international maritime law when flying in international airspace-in any event, I think how this trial/case turns out will be interesting/enlightening
It will be very interesting to see if the vessel has real documents or are they faked and has the vessel been following the official procedures of regular ship inspections. If I remember right there were some lacks in the condition of the ship, but nothing really fatal when FI inspectors checked it
