After initially claiming that the ICE agents approached the men "as they exited their vehicle," the new version has one of the men first peeing on the surgical center. Nothing was mentioned about this peeing for weeks, so while it's irrelevant, it looks like an ad hoc effort to discredit the workers

The men run when the masked men approach, which is their right. They weren't detained and ICE had no suspicion on which to base a detention. But remember DHS initially claimed they were "illegal alien targets" (eg it knew their status) b/c DHS does not racially profile (lol). We now know... DHS LIES

The affidavit explicitly says that DHS "later identified" the man as being in the country illegally. In other words, it racially profiled them and chased him without any reason to believe he was in the country illegally at all! And the man being chased was not the driver or the peer. ICE had NOTHING

So the man ran into the surgical center, and the surgical staff employees told them it was private property demanded a warrant and identification. You can even hear one staff member say: "You're not even a federal agent" after he refuses to identify himself. Another calls 911 to report a kidnapping

DHS says that this was a "hot pursuit" situation where no warrant is required. But even in a hot pursuit, DHS needs to show a law enforcement emergency to pursue non-felony suspects onto private property. This guy was not a felon, and there was no emergency. They had to get a warrant...

Even if there was an emergency, the officers still needed probable cause of an offense to enter private property, and they have already admitted that they did not have probable cause. No, racially profiling landscapers doesn't count. See multiple recent court cases from LA!

And so now they're prosecuting two employees for standing in the way of their illegal operation. It's unbelievable. These officers should be prosecuted for violating the Constitution every which way, but instead, it's Americans sticking up for the Constitution who are locked up.

Set aside the Constitution/search of private property. Section 287 of the Immigration and Nationality Act itself requires administrative warrants for ICE to even interrogate anyone about their citizenship unless they already have cause to believe that the person is "an alien"! Tell ICE to beat it.

So this was illegal from the jump. Then to actually ARREST anyone, ICE needs an administrative warrant OR probable cause that they've violated US immigration AND reason to believe that the person will escape before they can get a warrant, highly improbable with this guy locked inside the facility.

IIUC, running *can* be seen as creating reasonable suspicion, but there needs to be a newer, overriding principle, that negates the reasonableness if an innocent person in the targeted person's shoes would have a reasonable fear of being targeted based on protected characteristics.

It's slightly relevant in context because they're claiming that they don't do roving patrols that stop people based on racial profiling in Vazquez Perdomo. Admitting here that they initiated the stop based on "legal" profiling isn't the line they're pushing in multiple courts.
