Indeed it does take more time, but thatโs the process last time I looked. In all my planning career I donโt recall the courts being involved in a planning case. Application determination/Enforcement action, appeal (Planning Inspectorate) or call-in (Minister).
Still confused as to what a planning issue is doing in the courts given the normal routes for enforcement. Enforcement notice, appeal to planning inspectorate etc.
Is the main plank of the case that of planning permission/change of use? If so then the route is through enforcement action and not the courts. Would raise the question why these (mainly conservative) councils didnโt pursue when their own party of government started the practise.
