Normally I'd agree., but since this Scotus majority does not care about legal precedent or historical fact, I very much doubt that a case like this would *automatically* lose if it came before their docket! What matters is whether or not Trump wants it. The rest is just filler.
It's also one thing to work on winning over under-informed regular voters and quite another to try and woo GOP party leaders and MAGA cultists!

Having written a book about the Obama presidency, the main thing I'd fault him for would be building upon the "war-fighting" powers of his predecessors, most especially W Bush but not exclusively him. He should have dismantled them as best he could. Instead he gave his successors even more power

What's the point of a legal protection for a right that can't be exercised? Seems to me that any time the government admits that a right exists, there's an obligation to foster an environment where that right is actually practicable. Free Speech is accompanied by public education, etc.
Legislation like this might make sense long term, but would only stand up to reality after considerable changes are achieved. Conservatives will need to be scrubbed from SCOTUS, communities educated so that they are willing to self enforce, state resources mustered to coerce residual noncompliance..
