It can be difficult to demonstrate bad faith under 512(f), but "we filed the takedown without even reviewing the material to see if it was infringing despite the fact we thought it probably didn't infringe" probably meets that bar.

“We don't really review it [the list] because we are an agent for them,” Ananad said. “For the requests that we send out ourselves, usually they get reviewed, but sometimes they [clients] do a search by themselves, and they come across some content and they flag it and they're like, ‘We want this taken down.’ We don't review that because that is something that they want taken down. I'm not particularly sure about this case, but that is what happens. What we planned on doing was also reviewing these but it's usually not very fruitful, because the user is very sure they want that claim. And even if we say, ‘Hey, we don't think you should do that,’ they're like, ‘We want to do it. Just do it because I'm paying you for this.’ And if we just say, do it yourself, that kind of takes away the business from us. So that is basically how it works.”

“In the dead of night on a holiday weekend, the Trump administration ripped vulnerable, frightened children from their beds and attempted to return them to danger in Guatemala. We are heartened the Court prevented this injustice from occurring before hundreds of children suffered irreparable harm. We are determined to continue fighting to protect the interest of our plaintiffs and all class members until the effort is enjoined permanently.”

Jesus fucking christ. The Trump administration tried to send a bunch of children to Guatemala at 3 am and justified it by saying that the kids just wanted to return to their parents in Guatemala, but the kids actually told the court that they are afraid of being sent back to Guatemala.

Judge: I got a call at 2:36 a.m. because the govt chose this time on a holiday weekend to execute this plan. I have been up since then. I haven't been able to reach anyone from govt until this morning at 9:30 a.m. So absent this intervention, all children would already have been sent to Guatemala!

Maybe, but in my experience, when someone says "you can't publicize this information" they mean that you're not allowed to make that information public. So I think publicly acknowledging the relationship could still be considered "publicizing" it and get creators in trouble.

I think it's more that they moved from a very detailed political program describing the world they'd eventually like to see to a broader statement of positions that mentions specific policies they're currently fighting for – in part to give DSA candidates concrete policies to campaign on.

This is Ms. Gaines’s intuition as an activist, too: If people accept the premise that transgender women do not belong in women’s sports, then they have conceded that transgender women are not fully, truly women. As she sees it, more sweeping restrictions of transgender people flow from there, including the Supreme Court’s recent ruling that states can ban gender-affirming care for minors and the U.S. Olympic & Paralympic Committee’s change of its eligibility rules to bar transgender women from competing in Olympic women’s sports. “The gender ideology movement is a house of cards, and I believe it’s lying on that sports issue,” she said. “This will be the card that makes all of it crumble.”

It was originally a geopolitical division. First world = US/NATO, second world = Soviet sphere and third world = non-aligned. But after the fall of the Soviet Union, it was reformulated as an economic division, with second world = emerging markets.

As I said months ago, I think institutions have to plan for just never getting federal funds. If Trump can arbitrarily cut off funds and place unacceptable conditions on the funds, that money is as good as gone (unless you want to be a collaborator with the Trump admin).

You're right, but I don't think Mamdani is bending the knee to Jeffries here. (If he were, Jeffries would endorse him!) Taking meetings with skeptics to defend your positions and invite them to get on board while making it clear you won't bend the knee is a sign of strength.

Personally, I preferred in-class exams to take-home assignments, because I was a perfectionist when it came to papers but thrived under pressure. But that also makes me worry about what the shift to in-person exams will do to students who understand the material but crack under pressure.

It depends. In a situation like this, where it's sort of like a high-stakes diplomatic meeting, I think they use the same euphemisms. But when it's like two members of Congress who frequently work together, I think they're much more candid behind closed doors.

A serious primary challenge against Jeffries is unlikely. But if he doesn't endorse Mamdani, that creates real space for a potential pro-Mamdani challenger. Whereas if Jeffries endorses (and campaigns for) Mamdani, there isn't as much space for a primary challenge.

There's no reason not to take the meeting. Mamdani's time is precious, but meeting with the House minority leader for an hour or two is still worth it (especially when the meeting doubles as a chance to speak with other Black community leaders).

I don't think too many Zohran supporters are waiting with bated breath to see whether Jeffries endorses him (except insofar as it makes a potential primary challenge to Jeffries more or less likely).

It's not just that Jeffries hasn't endorsed. It's that he's creating this whole drama where he's a central figure – he has to have all these meetings before he can decide whether to endorse his own party's nominee, but he's not sure yet, but maybe he'll make a decision in the future, etc.
