The judge said that they couldn't order the release because by the time it got to their court, ICE had already intervened and ordered him to be held. State and municipal judges can't go against federal agencies.

I read documents down- thread that indicate such a hold is a request by ICE but cannot be commanded by them. It's possible that the judge could have required the release.

What if a citizen doesn’t have his birth certificate handy? What if his mother was illegal and couldn’t go to court to show his birth certificate without being jailed (for a misdemeanor)? What if more time passed and Gomez was sent to El Salvador, forever?

Those are some great questions you bring up. I feel that the fact that there in no opportunity to see a judge until it’s too late is such a major issue.
