Exactly! The Crown equity courts were the sovereign trying to do justice when the law provided no relief, the district court here is trying to restrain the "sovereign" from breaking the law. It's ๐ and๐ in my view.
jasonc99.bsky.social (@jasonc99.bsky.social) reply parent
Yeah I agree, people are saying "let's wait and see what they say on the merits" but I think the only way they could find irreparable harm to the gov here is if they are going to ultimately rule that the EO is constitutional. What's the harm in not being able to break the law?
jasonc99.bsky.social (@jasonc99.bsky.social) reply parent
Is there a chance this never gets back to SCOTUS for a decision on the merits? If the gov loses at the district level, why would they appeal? They can keep enforcing the EO against everyone else who wasn't a party to the suit, if they appeal they risk losing, no?
jasonc99.bsky.social (@jasonc99.bsky.social) reply parent
If I understand it correctly, the federal government no longer has an incentive to appeal when its actions are challenged on legal/constitutional grounds and it loses in district court, and there won't ever be a definitive ruling on whether it violated the law?
