While I support this, I'm not following how a city can tell federal agents what to do?

Broadly speaking, unless it is in contradiction to higher laws, lower laws can absolutely be passed. They're not telling ICE they can't enforce things, they're telling ICE "within this place you must adhere to this set of laws".

Yes, it would be great if the city of Chicago could require feds to identify themselves… but it can’t. Not under the most liberal interpretation of the law, certainly not under the law as interpreted by actual courts. It’s still good policy. It’s not bad because it fails to do what it cannot.

That's entirely reasonable. Federal agents should've been at least informing local authorities of their activities all along. The local police should NOT have to guess whether someone is a real federal agent or an impersonator, and they definitely shouldn't assume.

In Illinois, all government employees are barred from assisting in Federal law enforcement, unless they are compelled by a Federal Judicial warrant. There’s already been an inquest in Chicago, after CPD responded to an ICE agent issuing an “officer needs assist” through our local dispatch.

I do think that any person who is in violation of the law, and refuses to validate that they are acting under color of state or federal law, is subject to arrest by local police. As a long-time Chicagoan, I don’t think CPD has it in them to arrest a masked kidnapper, Federal agent!or not.

The Chicago police department is led by the Superintendent of Police, who is appointed by the mayor. I believe the mayor could have the Superintendent instruct the PD to shadow the Feds (non-confrontational) to make sure they are following constitutional law and protocol. No Warrant = No Raid

If any person refuses to comply with a city ordinance, and does not validate that they are acting under state or federal color of law, then that person is subject to arrest by the city’s police. At minimum, this law (if it had been written with real teeth) could compel Feds to ID themselves to CPD.
