If I were a judge, given the track record of DOJ, & Mr. Ensign in particular, I wouldn’t accept any factual statement from him. This is on a TRO application (hence no sworn witness), but there’s no reason to think what govt counsel says he’s been told by DHS in circumstances like this is true.

I can see that, & I can see a cottage industry of lawyers filling pro forma complaints & preliminary injunction motions. And administering a tariff system with tons of excepted companies would be a nightmare. And, yet, I could see this administration forging ahead.
I can see why the headlines are that the appellate court held the tariffs unlawful. But I feel like the striking down of the nationwide injunction against the tariffs may really matter more. This lawless administration will keep doing what the court says is unlawful as long as there’s no remedy.
