I've been trying to learn more about the Progressive Era & how it took decades of things like this happening with food & patent medicines & lead paint before real gov regulation. There were always some regular consumers who understood that, say, morphine & mercury were dangerous, but others didn't.
Why would a grocery store be selling milk to be used as cattle feed? Why would the dairy supply cattle feed to a grocery store? If current regulations aren't stopping this, then I feel like the businesses should face consequences for lying to customers about safety.
At the very least, hopefully, if this story is reported widely, small grocery stores will stop selling raw milk to avoid being sued and consumers who somehow didn't know it was dangerous will stop consuming it.

Questions to be address in trial: * Did the plaintiff ask about the label? What answer was she given? * Why was the health food store buying & selling raw milk at all? What measures did it take to ensure safety? * Why was the dairy selling to the store? What measures did the dairy actually follow?
The dairy probably only has ordinary liability. Did they handle the milk in an industry accepted sanitary fashion, did they label it clearly and not deceptively? A buyer would expect it wasnt contaminated, spoiled, or for humans. The STORE probably has deception liability by discounting the label.
In the circumstances, I'm prepared to cut the woman some slack. She was ignorant & misinformed, but did at least take the trouble to ask a supposedly trustworthy and informed party (established health food store) for clarification. The real question: What are Florida authorities doing about this?

Agricultural stores sell products for this purpose. These are typically pasteurized as well or sterilized to make them shelf stable. Most farmers don't want their livestock getting sick either.

I agree about the intent of the food store, but it might be iffy in law. The manufacturer labelled it "Not for human consumption" clearly enough for her to read and question. Who at the store told her it was safe? Why did she believe them and not the manufacturer? She'll be asked in court.

Safety regulations are better enforced by regulators directly, issuing orders etc.; tort is comparatively slow & unreliable. Maybe it could work in this case, & maybe that would be better than the alternative given regulatory inaction, but it's not suited to purpose.

This case is really odd. She says she never even drank the milk. She only gave it to her toddler who got e coli - presumably from the unpasteurized milk - and campylobacter (can be in raw milk but isn't mentioned in the segment). She then got the campylobacter from the kid she sickened 1/
by feeding him raw milk, which she had been doing for months, she said! So if this is the case, it seems she endangered not just her kid, but also herself, her contacts, the hospital staff, etc. by the idiotic act of feeding her kid raw milk. Yeah, eff her. I'm sick of these people.

I had a friend with backyard goats, and I often got gallons of raw milk from them... for the express purpose of fresh cheesemaking, and of course first step is freaking pasteurizing the stuff myself. If you think UHT kills the flavor, the tables for how long is required at lower temps are there!

if you read the argument, they say that the coffee was served and kept at 82-88C, where comparable restaurants in the area kept it at least 10C cooler, if not more. there’s a difference between hot and almost boiling. they aren’t serving customers oil straight from the deep fryer, you know
I read it. With a lower temperature she still would have burnt herself just not this severe. She took the coffee and put it between her knees so she definitely should have noticed if it's too hot. I don't blame her but I don't think McDonalds is to blame either. It was an accident.

Legal liability for companies selling raw milk is a good thing, even if their customers should know better. If this kind of thing makes dairies think twice before selling it in the future I'll take it.
I think they already label it "not for human consumption." If they offer unpasteurized products for human consumption without appropriate warnings, they should be held liable. Otherwise, consume at your own risk.
